In an entirely unsurprising vote Russia and China have voted against referring the situation in Syria to the ICC. Whilst I do not accept the position advocated that a referral would have ended the conflict I do accept that a referral was entirely necessary to address crimes committed by all sides. Let us now see how the international community moves forward. I have always advocated for the creation of an ad hoc international tribunal to deal with the situation in Syria and that is clearly the discussion that must now take place. The ICC was never likely to solve the conflict in Syria but a well thought out system of justice and accountability is now clearly needed.
