The Syrian Regime Targeted a School in Al-Qaboun and Killed at least 14 Children in #Syria #Damascus http://fb.me/6S79I3P1V

DCHRS deplores this criminal act of the Assad regime involving the targeting of a school – a type of building which is considered to be a forbidden target in times of war. This crime can be classified as a war crime in accordance with Article 8-2-b-ix of Rome Statute of the International Criminal Court: “Intentionally directing attacks against buildings dedicated to religion, education, art, science or charitable purposes, historic monuments, hospitals and places where the sick and wounded are collected, provided they are not military objectives” and Article 8–2-b–ii: “Intentionally directing attacks against civilian objects, that is, objects which are not military objectives”

Therefore, DCHRS urges the international community, relevant organizations, the United Nations, and the Security Council, to take immediate action to stop and end the Assad regime’s ongoing violations against the civilians in Syria.

Moreover, DCHRS urges the concerned parties to uphold their responsibilities in the face of the Syrian regime’s use of lethal weaponry, and its continuous targeting of civilians. The Damascus Center for Human Rights Studies cautions that  the international community’s silence will lead to further atrocities, as the Assad regime will continue to shed the blood of innocent civilians.

The horrific murders of people at prayer that recently occurred in Jerusalem raises many more questions than answers. The responses to it were varied. CNN saw in it that Israeli police killed two Palestinians. Israeli politicians made their usual vapid comments, promises and revenge statements, all of which in the past have led nowhere. Learned rabbis and savants have attempted the futile task of reading God’s mind, so to speak, to explain what cannot be explained. Redoubled efforts at greater acts of charity and more meaningful prayer services are undoubtedly noble goals but are hardly words and actions of comfort, consolation or explanation. It would be mistaken to believe that the Italian Constitutional Court understands its blockade of international customary sovereign immunity as a protection of the Italian Constitution only. The Court backs its international-relationships-disrupting decision by highlighting that the right to judicial protection is “surely among the great principles of law recognized by any democratic civilized nations in our time.” This affirmation clearly echoes Art. 38 (1) of the statute of ICJ (“The Court … shall apply: … the general principles of law recognized by civilized nations”). 

And, the Court adds, the European Court of Justice also has declared that “the obligations stemming from an international agreement cannot violate fundamental rights.” In other words, the Italian Court justifies its attitude in saying that the kind of values it is protecting characterizes democratic legal civilizations and the EU. All things considered, the theory of counter-limits was conceived to shield the Constitution against EU laws, but was never used; here it is backed by the European Court of Justice’s decisions. What used to menace, specifically the EU, has now become a powerful source of legitimization.
