Folk International Law and Syrian Airstrikes
The Obama administration’s legal approach to global NIAC and to targeted killing is a result of convergence-based law and lawyering. Arguments devised in moments of great urgency, and in a sense that some rules (however poorly constructed, and however faulty under existing international law) were better than no rules, a la the early Bush administration. The problem is that, having contributed to this mess, it is difficult to step back and criticize it.
Today, the American public is confused (a number of friends and colleagues responded to the Isikoff article by expressing outrage that President Obama had decided to “lower” the standards applicable to civilian casualties), and the international legal arguments available to those uncomfortable with the “Forever War” are considerably weakened by the “folk international law” that many liberal international lawyers helped to create. Traditional, currently binding LOAC does not require a near-certainty that a lawful attack will not kill civilians.

عام 1441 سلمان العودة
نحن الآن في نهاية سنة «1435 من الهجرة» وهذ المقال كُتب في الأسبوع الأخير من شهر ذي القعدة، ونُشر في مطلع ذي الحجة، سقطت صنعاء بيد “الحوثيين” سقوطاً درامياً مثيراً، وتمّت العملية بانسيابية غريبة؛ توحي بتواطؤ إقليمي ودولي، ولم يُسمع صوت احتجاج أو تنديد، ولا أُغلقت سفارة، ولا وُزِّعت ألقاب التطرّف والعنف والإخلال بالأمن والعدوان على سلطة النظام..!!.
إنه لغز محيِّر، ودائماً نلجأ إلى القول المأثور: «فتنة تدع الحليم حيراناً» وقبلها عاشت بغداد ودمشق أوضاعاً مأساوية غير مسبوقة، والعالم الذي كان يتفرَّج على مجازر الأنظمة ويقوم بإحصاء الضحايا – وهم بمئات الآلاف – دون أن يُفكِّر في منع الطيران على الأقل، بدأ يتدخَّل تحت ذريعة محاربة الإرهاب..!!.
لن يتدخَّل العالم إلا بتنسيق مع النظام وإلا لصارت طائراته هدفاً، فطائرات النظام التي تقصف المدنيين هي في نفس المجال الجوي، والناس ضد الإرهاب ولكنها تسأل: كم قتل الإرهاب المستهدف الذي تحالف العالم لمحاربته، وكم قتل الإرهاب الحكومي المدجّج بالطيران والبراميل المتفجِّرة والأسلحة الكيماوية؛ هل الأهمّية فقط للأسلوب الذي يتم به القتل بحيث إذا استخدم سلاحاً كيماوياً يتهيّأ العالم لضربه، وإذا قتل بطريقة أخرى يكتفي بالإدانة، أم القصة تتعلّق بإنسانية المقتول؛ فإن كان عربياً أو مسلماً فالخَطب يسير، أما إن كان من جنسية غربية أو اسرائيلية فهو خط أحمر..؟!.
ليبيا تعيش أوضاعاً غير مستقرّة، وتتصارع فيها القوى سياسياً وعسكرياً، مما يمهِّد للتدخُّل الإقليمي والدولي، بروز القوى المحليَّة؛ التي كانت تعيش في الهوامش والأطراف، وقفزت إلى صدارة المشهد، هل هو مؤشر لمخطّط تقسيم جديد للمنطقة العربية؛ بمعنى أنه تغيُّر في الاستراتيجية الدولية المهيمنة، أم أن ما يحدث هو بسبب تراجع الدور الأمريكي وضعفه مما ولَّد فراغاً تم ملؤه ببعض القوى الجاهزة الحقيقية أو المتسلِّقة والانتهازية التي تظهر سريعاً وتتراجع سريعاً، وتكون متحالفة مع غيرها من قوى الثورة المضادة أو الدوائر الإقليمية التي تحرّكت مطامعها الاقتصادية والسياسية بعد تراجع أحداث الربيع العربي..؟!. على أيِّ الاحتمالين؛ فالمحصِّلة أن الأوضاع غير مستقرة لا في صنعاء ولا في غيرها، ولن يستتب الأمر للحوثيين كمستفردين بالسلطة ولا لغيرهم، والأوضاع السياسية تحتاج إلى فترة كافية حتى تتضح معالمها، وهي أشبه باللوحة الفنية التي تتشكَّل شيئاً فشيئاً، والمتعجِّل قد يرى بداياتها فيظنها شيئاً وعند النهاية يكتشف أنها شيء آخر مختلف. والمجتمعات العربية تفتقد المشروع النهضوي الذي تلتف حوله، فهي في أمر مريج وتدافع وتنازع، والناس يصرخون ثم ينتقلون للحديث عن مأساة أخرى دون تأثير يُذكر؛ لأنه لا يوجد وعاء جامع يستوعب جهود الأفراد والمجموعات، فهي عملية حرائق تشب هنا وهناك، وإطفاؤها يتم وفق نظام الفزعات، والأكثرون منهمكون بالتحليل – ولو كان سطحياً أو مبنياً على معلومات ناقصة أو مضلّلة – ثم بالتبشير بما سيحدث من وراء ذلك، وهم مأخوذون بالخوف على أنفسهم أو على مبادئهم التي يؤمنون بها أو القلق من تنامي قوى إقليمية كإيران؛ ردّة الفعل المباشرة هي غريزة فطرية، ولكن حين يسكت عن موسى الغضب يأتي دور المدارسة والتفكير والانتقال من الاستجابة للغريزة إلى التعقُّل والتروِّي وتقليب وجوه الرأي. نظرياً علينا ألا نتعجَّل في المواعدات الظنية بأنه سيحدث كيت وكيت، فالغيب لا يعلمه إلا الله، ونحن لسنا خبراء في السياسة، ولا ضليعين في رسم أبعادها واحتمالاتها، والتدبير هو بيد الله، وما القوى العالمية والمحليَّة إلا أدوات بشرية عادية قد تريد شيئاً وتخطّط له ويريد الله غيره {وَمَكَرُوا مَكْرًا وَمَكَرْنَا مَكْرًا وَهُمْ لَا يَشْعُرُونَ، فَانظُرْ كَيْفَ كَانَ عَاقِبَةُ مَكْرِهِمْ أَنَّا دَمَّرْنَاهُمْ وَقَوْمَهُمْ أَجْمَعِينَ، فَتِلْكَ بُيُوتُهُمْ خَاوِيَةً بِمَا ظَلَمُوا إِنَّ فِي ذَلِكَ لَآيَةً لِّقَوْمٍ يَعْلَمُونَ} علينا أن ندرك أن عشر سنوات على الأقل لابد منها حتى تتجلّى الرؤية، ونستطيع قراءة اللوحة الفنية بقدر من الوضوح، أما الآن فهي الصورة المرتبكة المضطربة؛ هي خطوط هنا وخطوط هناك، وألوان متداخلة تجعل الناظر في حيرة من أمره. عقد من الزمن منذ بداية أحداث الثورات العربية وما تلاها ربما يحدّد القوى التي نجحت في المحافظة على نفسها واستثمار الفرص بطريقة صحيحة، والقوى التي كانت ظواهر وقتيَّة تمَّ النفخ فيها أو توظيفها، ومع الزمن تعود إلى حجمها الطبيعي. وفي عنوان المقال أضفت سنةً ليصبح الرقم «1441» اقتباساً من رؤيا يوسف – عليه السلام – حين قال: {ثُمَّ يَأْتِي مِن بَعْدِ ذَلِكَ عَامٌ فِيهِ يُغَاثُ النَّاسُ وَفِيهِ يَعْصِرُونَ} مع أنه ليس في رؤيا الملك إلا سبع سنوات، ولكن التحديد بسبع يدل على أن ما بعدها مغاير لها، ولأن الأوضاع التي تتشكَّل تحتاج إلى فترة ليراها الناس بوضوح ويتحدّثون عنها، فإضافة خمس سنوات إلى تفكيرنا الحالي القلق يمنحنا فسحةً وهدوءاً نفسياً وفكرياً؛ فلا نقع تحت طائلة الإحباط اللحظي واليأس القاتل أو الإحساس بأن الأحداث تتحرّك دوماً ضدنا، ولا نتحوّل إلى كائنات مكتئبة متذمّرة، فهذا لن يكون خيراً لنا، ولن يسمح لنا بالفعل والمشاركة في التغيير، وثمَّ في ضمير الغيب ألوان من التغيير الإيجابي الذي لم نكن نختاره ولا نفكر فيه، ولا نحسن الوصول إليه بل قد نكون ضده، ولكن الله يعلم أنه الأفضل {وَاللّهُ يَعْلَمُ وَأَنتُمْ لاَ تَعْلَمُونَ}.
وعمليَّاً فالفترة الحالية مهمّة؛ لأنها فترة فرز وتكوين جديد، وكما يقال «السابق لابق» وإذا كانت بعض شعوب المنطقة متفرِّجة تكتفي بالحديث، فثمَّ شعوب أخرى بيدها الكثير من القوة والتأثير، وعليها أن تستحضر قول ربها: {فَأَمَّا الزَّبَدُ فَيَذْهَبُ جُفَاء، وَأَمَّا مَا يَنفَعُ النَّاسَ فَيَمْكُثُ فِي الأَرْضِ} فحين يكون المقصد البحث عمّا ينفع الناس سيكتب للجهد الخلود والتأثير بمقتضى السنة الإلهية؛ التي نطقت بها آية الرعد، وحين يكون القصد العلو في الأرض والفساد فهو مثل الزبد؛ الذي يطفو فوق السيل ويراه الناس وكأنه هو الأقوى والأغلب والمسيطر؛ بينما هو هواء ذاهب لا حقيقة له ولا خير فيه، وكم من قوى سادت قليلاً ثم بادت كأن لم تكن، والشيوعية أظهر مثال والنهاية مؤكدة، مؤكدة تماماً دون شك عند من يعقلون عن الله {فَأَوْحَى إِلَيْهِمْ رَبُّهُمْ لَنُهْلِكَنَّ الظَّالِمِينَ، وَلَنُسْكِنَنَّكُمُ الأَرْضَ مِن بَعْدِهِمْ} المهم ألا نكون نحن ظالمين، فسنن الله لا تحابي أحداً كائناً من كان، إذاً دعونا نُرحِّل تحليلاتنا لأحداث الساعة؛ لنتساءل: ماذا سيكون عليه الحال في ذلك العام..؟!.

Kalachakra 2016 at Bodh Gaya
DHARAMSHALA: Sikong Dr. Lobsang Sangay today announced that His Holiness the Dalai Lama will give the 34th Kalachakara initiations at Bodh Gaya in India from 15 -25 January 2016.
“The 14th Kashag is immensely blessed that His Holiness the Dalai Lama has kindly consented to our request to give the Kalachakra initiation at Bodh Gaya,” Sikyong said at a prayer service held today.
The Department of Religion and Culture of the Central Tibetan Administration will be mainly responsible for the Kalachakra teachings along with other co-sponsors.
Since 1954, His Holiness the Dalai Lama has given 33 Kalachakra Initiations, including four times at Bodh Gaya in 1974, 1985, 2003 and 2012. The Kalachakra teachings in 2012 drew over 200,000 devotees from across the world, which include about 8,000-10,000 Tibetans from Tibet.

In response to the numerous threats and abusive comments I received today following my press conference yesterday following the Bangladesh Supreme Court’s verdict on Sayedee I would say the following. Any person, irrespective of what they are charged with, deserves a fair trial otherwise the process will have little meaning and will not contribute to justice. Attacking an accused’s lawyer for expressing legitimate concerns demonstrates an ignorance of the rule of law. If Bangladesh wants to contribute to long term stability, reconciliation and the development of international criminal justice it needs to change its strategy. Attacking the legal representatives of those accused of war crimes is quite frankly stupid and further demonstrates the mob rule that prevails in Bangladesh. This must change.
British lawyer Toby Cadman, who is defending the Jamaat-e-Islami leadership, has asked Bangladesh government to order a review of Delwar Hossain Saydee’s conviction before “an internationally appointed, independent and impartial tribunal”.

آیا فتوای مقام معظم رهبری در مورد محل اقامت دانشجویان و شکسته بودن نماز آنها با قصد کمتر از ده روز عوض شده است؟
اجمالا بله. چون نظر حضرت آقا در سابق این بود کسی که صرفا برای تحصیل مسافرت زیاد دارد و کثیرالسفر است – که بین سفرها معمولا ده روز فاصله نمیشود مثل دانشجویانی که اول هفته به محل تحصیل میروند و آخر هفته برمیگردند یا دو روز در هفته میروند شهر دیگری که فاصله حداقل ۲۲.۵ کیلومتر دارد، یا دانشگاهشان بیرون شهر است سی کیلومتری چهل کیلومتری بیرون شهر است – میفرمایند باید نماز را شکسته بخوانند مگر اینکه تحصیل شغلشان محسوب شود؛ مثل کسی که مامور به تحصیل است یا تعهد خدمت دارد.
اما اخیرا فرمودند که احتیاط کنند یعنی چنین افرادی که برای تحصیل، مسافرت زیاد میروند و کثیرالسفر هستند نمازهای چهار رکعتی را هم تمام بخوانند هم شکسته و در این مسئله میتوانند به فتوای مجتهد اعلم دیگری رجوع کنند که اگر آن مجتهد اعلم میفرماید کامل است، کامل بخواند و اگر میفرماید شکسته است شکسته بخواند.

درگذشت روحانی مبارز و غیور مرحوم حجت الاسلام آقای حاج شیخ محسن دعاگو رحمة الله علیه را به خاندان محترم ایشان، همسر و فرزندان و دیگر بازماندگان و علاقمندان تسلیت میگویم. تلاشهای ارجمند در دوران مبارزات نهضت اسلامی در مشهد و خدمات گسترده در مسئولیتهای گوناگون پس از انقلاب، بخشی از زندگی نامهی این روحانی پر تحرک است که به فضل الهی، مشمول رحمت و قبول حضرت حق خواهد بود انشاء الله.

I am very happy to share with you that our Excise Department has been conferred the prestigious and highest Platinum Award by Skoch Foundation at the 37th Conference on “Minimum Government, Maximum Governance”, hosted with support by a number of Central Government Ministries. Adjudged best in the category, “Finance and Taxation”, the award, out of 5000 nominations, is in recognition of our Government’s unique initiative of introducing e-Abgari Scheme for online filing of tax and tracking performance under the Excise Department.
This path breaking step has resulted in duty collection through e-payment move up to 98.2% in 2013-14 from Nil four years ago and treble State’s revenue collection in this sector to nearly Rs.3000 Crore in just four years.
In addition, our Panchayat and Rural Development Department has also been conferred the Skoch Order of Excellence for outstanding work in 100-Days Work Scheme and Skoch Order of Merit for Web-based Monitoring System by Institutional Strengthening of Gram Panchayats Project in Bengal.
I congratulate our Excise and Panchayat & Rural Development Departments for this excellent performance.

A large section of my brothers and sisters in Kashmir are extremely distressed due to massive floods.
Huge number of tourists from different places are also stranded in Kashmir. Many tourists from my State are stranded there as well. In this hour of crisis, we expect everyone to co-operate.
For immediate relief, we are sending drinking water pouches to the flood affected areas.
We are by their side and hope that flood water would soon recede and people would get back to their normal lives.

Indiscriminate Shelling Killed Nearly a Thousand Syrians
Casualty Report for August 2014
As violence and systematic human rights abuses continue by the Syrian government regime’s forces. DCHRS documented in the month of August, 2014 a total of 1854 victims who were killed by regime’s forces and their loyal militias in addition to the armed groups. 79% of them were civilians reaching a total of 1462 victims; however the other 392 remaining victims were armed opposition forces and rebels accumulating a rate of 21% approximately.
DCHRS documented a total of 272 children victims at a rate of 15% of the total victims. Additionally, the number of documented women was 125 victims at a rate of 7%.
DCHRS analyzed that the main cause of death for 994 victims was indiscriminate shelling and airstrikes targeting the residential areas in addition to 86 who were killed by sniping and indiscriminate shooting. Furthermore; the cases of extrajudicial killings and field executions that were perpetrated by regime’s forces resulted in the death of eight victims. In addition, the total number of victims who were tortured to death inside the prisons and the detentions centers of the Syrian security authorities were 225 victims. The number of victims who were killed by armed groups such as IS and other armed groups is 37 and 46 were killed by unknown source of bullets. Moreover, the number of people who were killed due to starvation and the imposed siege is 10 in addition to 56 victims who died in different bombings.
The province of Damascus and its suburb, which is witnessing a reckless indiscriminate shelling in addition to the imposed siege that wide parts of Damascus suburb are suffering from, recorded highest number of casualties totaling in 550 where 444 (81% of them were civilians). Finally the center documented six non-Syrian victims from other nationalities who were fighting with Syrian Armed oppositions.
DCHRS learned that the Syrian regime forces continue to target civilians and they use direct brutal violence against them. As a result the number of civilians reached 79% of the total number of victims. Also since about 54% of the death cases were caused by shelling, missiles, barrel bombs, and airstrikes. DCHRS indicates and stresses that such high number of casualties in correlation to the cruel cause of deaths are obvious evidences that the Syrian regime forces are intentionally targeting civilians, ruthlessly punishing them, and recklessly ignoring any basic right of their existence. Furthermore the results clearly stated the violations of international human rights laws and humanitarian laws even with other causes of deaths such as torture, extrajudicial killings, and other forms of violations that are categorized under war crimes and crimes against humanity.
DCHRS demands protecting civilians according to the laws approved by the U.N in 2005. In addition since DCHRS is a member of the International Coalition for the Responsibility to Protect (ICRtoP), DCHRS appeals to the international community to practically enforce the “Responsibility to Protect”. Furthermore DCHRS calls all the international medical and humanitarian organizations to provide support, medical assistance, and relief to ease the suffering of the Syrian people inside Syria and abroad. Finally DCHRS demands to prosecute the perpetrators of war crimes and crimes against humanity and to bring them to justice.

DCHRS worked on a variety of documentation projects. Such projects included daily casualty reports, massacre reports, and other human rights violations reports. Also DCHRS has been working on advocacy and lobbying in different human rights institutions in order to educate and acknowledge about the deteriorating human rights situation in Syria.. After the launch of the Syrian revolution, the center increased its activities through working, communicating, and coordinating with many members and activists. Thus the center began documenting daily violations committed by the Syrian regime forces that can be classified as crimes against humanities and war crimes. Such violations included: extrajudicial killings, massacres, arbitrary detentions, enforced disappearances, rape, torture in prisons. DCHRS opened local offices in Syria in order to document, collect, and observe human rights violations on the ground. DCHRS submitted those reports to many international and regional human rights organizations and communicated with the Report of the independent international commission of inquiry on the Syrian Arab Republic on Syria.
