(8. April) Von einem „beispiellosen Dammbruch“ spricht Herbert Langthaler, Vorstandsmitglied der asylkoordination österreich, angesichts der vorliegenden Notstandsverordnung, die ins Asylgesetz eingebaut werden soll. „Nicht nur der Inhalt, sondern auch die Vorgehensweise stellt einen unerhörten Angriff auf den österreichischen Rechtsstaat dar“, zeigt sich Langthaler entsetzt. Die Möglichkeit, durch die Ausrufung des Notstandes das Asylgesetz außer Kraft zu setzen, soll nämlich offenbar ohne Begutachtungsverfahren als Entschließungsantrag durch das Parlament gepeitscht werden.
Geplant ist, Flüchtlinge an den Grenzen zurückzuweisen und jene, die unter Umgehung von Grenzkontrollen eingereist sind, in so genannten „Registrierstellen“ zu konzentrieren und von dort zurückzuschieben, auch wenn sie einen Asylantrag gestellt haben. „Wenn die SPÖ dem zustimmt, ist dies der nächste Schritt zur Selbstaufgabe“, kommentiert Langthaler das Vorhaben.
Möglich wird eine Zurückweisung und Zurückschiebung von Flüchtlingen, obwohl sie einen Asylantrag gestellt haben, durch eine Regelung, die schon seit der letzten „Reform“ des Asylverfahrens Teil geltenden Rechts ist. Es wird ein Unterschied zwischen „einen Asylantrag stellen“ und einem „eingebrachten Antrag“ gemacht (§17 Abs. 1 bzw. 2 AsylG). Als „eingebracht“ gilt ein Asylantrag erst, wenn das Bundesamt für Fremdenwesen und Asyl eine Anordnung (Prognose) erlassen hat, ob das Asylverfahren in Österreich zugelassen wird oder ein Dublin-Verfahren eingeleitet wird. Die sich so ergebenden Rechtsschutzlücke soll in der geplanten Notstandsverordnung genutzt werden, um Schutzsuchende ohne die Einleitung eines Asylverfahrens außer Landes schaffen zu können.
„Es stellt sich natürlich die Frage, wohin ich jemand zurückschieben will, wenn ich nicht weiß, von wo die Person eingereist ist“, relativiert Langthaler die Praxistauglichkeit der Vorlage. „Hier wird in erster Linie ein Klima der Unsicherheit und Angst geschaffen und Vorbereitungen getroffen, bei Bedarf auch andere Grundrechte außer Kraft setzen zu können.“

Eine beunruhigende Etwicklung: Die Zahl der unmündigen (unter 14 Jahren) Flüchtlinge ist wieder gestiegen. Vor allem bei den SyrerInnen kamen in Febraur drei mal so viele Kinder unter 14 (106) als Jugendliche zwischen 14 und 18 (33).

Vielleicht eine blöde Idee: In der Landstarßer Hauptstraße steht seit drei Wochen ein pipifeiner ziemlich neuer Würstestand leer. Jetzt finde ich den auf der Nachfolgebörse der WKO-Wien. Vielleicht wäre das ja was für ein Projekt: Gehobener Imbis, Streetfood aus Österreich und dem „Orient“ (müsste halt was ein bisserl besonderes sein). Gefragt sind wahrscheinlich vor allem ein Investor und ein paar Leute mit Gastroerfahrung aus ihren Herkunftsländern (und guten Nerven) . Ich hab allerdings noch nicht gefragt, ob die den Stnd für so ein Projekt weitergeben würden.
