Erklärung der asylkoordination zu „Obergrenzen“ im Flüchtlingsschutz
Asyldebatte gefährdet europäische Grundrechte
Kann man europäische Grundwerte einfach über Bord werfen, nur weil eine größere Anzahl von schutzsuchenden Menschen aufgenommen werden wollen? Die Vorschläge zur Meisterung der sogenannten Flüchtlingskrise, die in den letzten Wochen als Heilmittel präsentiert wurden, entfernen sich von den Grundwerten immer mehr und sind auch mit der in Österreich und in der Europäischen Union verbindlichen Genfer Flüchtlingskonvention nicht vereinbar. Das Recht auf Asyl ist in der EU- Grundrechtecharta verankert, diese enthält auch die Verpflichtung der Mitgliedsstaaten, grundlegende Verfahrensrechte in jedem Einzelfall einzuhalten.
Das Europarecht legt nicht nur den Handlungsrahmen bei der Flüchtlingsaufnahme fest, es sind auch eine Reihe von Verpflichtungen gegenüber Flüchtlingen an den Grenzen einzuhalten. Dazu zählen das Verbot, Flüchtlinge einer lebensbedrohlichen Situation auszuliefern, indem man sie an der Grenze zurückweist. Wird das zentrale Schutzinstrument für Flüchtlinge, die Genfer Flüchtlingskonvention in Frage gestellt, gerät auch der Schutz von Menschenrechten, wie beispielsweise der Anti-Folterkonvention, der Konvention zur Abschaffung der Todesstrafe oder der Erklärung zur Beseitigung von Gewalt gegen Frauen ins Wanken. Die Architektur der Grund- und Menschenrechte wird durch solche Abschottungs- und Abschreckungsmaßnahmen untergraben.
Neben dem leichtfertig Infragestellen der europäischen Grundwerte dürften aber auch zahlreiche praktische Probleme nicht bedacht worden sein. Es ist völlig realitätsfern zu glauben, dass das Ausrufen einer Obergrenze Schutzsuchende davon abhalten wird nach Österreich zu kommen. Es hat sich zwar gezeigt, dass der Ausbau der Kapazitäten im vergangen Jahr mit etlichen Problemen und Verzögerungen verbunden war, dies kann jedoch nicht als Indikator dafür herhalten, dass weitere Möglichkeiten der Unterbringung und Versorgung nicht mobilisierbar wären.
Nebeneffekt der jetzt angedrohten Maßnahmen ist, Schlepperei zu fördern, obwohl gerade diese bekämpft werden soll.
Mit der Errichtung von einigen Hot-Spots wird die Aufnahme von Flüchtlingen in der EU nicht gelöst werden. Innerhalb der EU ist die Übernahme der Flüchtlinge umstritten. Österreich könnte als einer der Mitgliedsstaaten die eine größere Anzahl aufgenommen hat hier eine aktivere Rolle übernehmen, ein besseres Verteilungssystem in der EU zu forcieren.

Wenn ein Mensch, sein Heimatland verlässt und dort all seine lieben Menschen zurücklässt, ist das schmerzlich und tragisch genug, denn er tut dies in Not.
In diesem Sinne appelliere ich an die politischen Verantwortlichen:
Flüchtlingen Zugang zu Bildung und sozialen Mindestrechten zu ermöglichen, sich dafür einzusetzen, dass Flüchtlinge ihre Schutzrechte vor Gericht effektiv einklagen können, sich dafür einzusetzen, dass Personen und Organisationen, die sich aus humanitären Gründen um Flüchtlingen kümmern, frei arbeiten können, dass sie Flüchtlingen die Möglichkeit eines legalen Aufenthalts geben.
Ich appelliere an alle Muslime, dass sie Flüchtlingen helfen, wo es möglich ist. Wir dürfen dabei nicht vergessen, dass die ersten Muslime auch Flüchtlinge waren.
Es gibt im Leben nicht schöneres als den notleidenden Menschen zu helfen und sie glücklich zu sehen.
