We, the undersigned international lawyers, gathered at the European Society of International Law 11th Annual Meeting in Oslo on 12th September 2015, and other international law scholars and experts, condemn the failure to offer protection to people seeking refuge in Europe, and the lack of respect for the human rights of those seeking refuge.
In particular, we express our horror at the human rights violations being perpetrated against those seeking refuge, in particular the acts of violence, unjustified coercion and arbitrary detention.
We note that European states have obligations not only to refugees and migrants on their territories, but that international refugee law rests on international responsibility sharing. The world’s refugees are disproportionately outside Europe. We note that over nine-tenths of Syrian refugees are in five countries, Turkey, Lebanon, Jordan, Egypt and Iraq. We note that around one quarter of Lebanon’s population comprises refugees.
We note that all European states have obligations not only to refugees as defined under the 1951 Convention on the Status of Refugees, but also to those protected against return under international human rights law and customary international law. We note that this broad duty of non-refoulement protects all those at real risk of serious human rights violations if returned. They should be afforded international protection. EU Member States have further obligations under EU law.
We urge European states and the EU to alleviate the humanitarian crisis, prevent further loss of life in dangerous journeys to Europe by providing safe passage, and live up to their obligations in international and EU law.
We recall the legacy of Fridtjof Nansen, the first League of Nations High Commissioner for Refugees, and the initiator of the Nansen passport, created to facilitate the safe passage and legal migration opportunities for refugees and stateless persons.
We urge European states and the EU to:
– meet their obligations of international responsibility-sharing, to resettle significant numbers of refugees and provide aid to countries hosting large numbers of refugees.
– as regards those seeking protection in Europe, abandon those policies which prevent safe and legal access to protection. The UNHCR estimates over 2,860 people have died at sea trying to get to Europe this year alone. Suspending carrier sanctions and issuing humanitarian visas would largely prevent the need for those seeking refuge to make dangerous journeys.
– respect and protect the human rights of those seeking refuge once they are in Europe, including by enabling them to access asylum procedures or ensuring safe passage to countries where they wish to seek international protection.
– immediately suspend Dublin returns of asylum-seekers to their first point of entry, but ensure that its rules on family reunification are implemented fully and swiftly.
– relocate asylum-seekers and refugees in a manner that respects the dignity and agency of those relocated, and increases Europe’s capacity to offer protection.
– replace the Dublin System with one which accords with international human rights law and respects the dignity and autonomy of asylum-seekers, and supports international and intra-European responsibility-sharing.
– implement fair and swift procedures to recognize all those in need of international protection.
– while claims are being examined, afford those in need of international protection, at a minimum, the reception conditions to which they are entitled in international human rights and EU law.
– respect the right to family life, including positive obligations with regard to family unity, facilitation of swift family reunification and family tracing.
– treat all refugees, asylum-seekers and migrants with dignity and respect, respecting and protecting their human rights, irrespective of status.

OPFERFEST 2015
Das Opferfest währt vier Tage. Am frühen Morgen des ersten Tages versammelt sich die Gemeinde in der Moschee für ein spezielles Feiertagsgebet. Danach stehen die sozialen Kontakte im Mittelpunkt: Man trifft Familie und Freunde und pflegt Bekanntschaften.
Das Fest hat auch einen Charakter der Versöhnung unter den Menschen. Sollte es Missstimmungen geben, so ist jetzt der ideale Zeitpunkt um diese auszuräumen, da allgemein die Gemeinschaft nicht dadurch belastet werden sollte. Die Kinder freuen sich über Geschenke. Gerne veranstaltet man Feiern, um den Gemeinschaftscharakter zu betonen.
Die höchsten Feiertage der Muslime stellen die Geschwisterlichkeit und Menschlichkeit in den Mittelpunkt. Soziales Miteinander und Einstehen füreinander in der Gesellschaft sind Werte, die bei diesem Fest besonders im Mittelpunkt stehen.
Das Fleisch ist des Opfertieres zu dritteln. Ein Teil geht an Bedürftige, ein weiterer an Nachbarn und Freunde und erst der letzte Teil ist für den Eigenverbrauch bestimmt. Wenn die Pilger/rinnen arm sind und eine große Familie haben, dürfen das ganze Fleisch für sich behalten.
Das neue Islam Gesetz sichert den Muslimen weiterhin die Möglichkeit des Schächtens und bei den Feiertagen frei zu nehmen zu:
§ 12. (1) Die Religionsgesellschaft hat das Recht, in Österreich die Herstellung von Fleischprodukten und anderen Nahrungsmitteln gemäß ihren innerreligionsgesellschaftlichen Vorschriften zu organisieren.
(2) Bei der Verpflegung von Mitgliedern der Religionsgesellschaft beim Bundesheer, in Haftanstalten, öffentlichen Krankenanstalten, Versorgungs-, Pflege- oder ähnlichen Anstalten sowie öffentlichen Schulen ist auf die innerreligionsgesellschaftlichen Speisegebote Rücksicht zu nehmen.
§ 13. (1) Feiertagen und der Zeit des Freitagsgebetes wird der Schutz des Staates gewährleistet. Ihre Termine richten sich nach dem islamischen Kalender. Die Tage beginnen mit Sonnenuntergang und dauern bis Sonnenuntergang des folgenden Tages. Die Gebetszeit ist am Freitag von 12.00 Uhr bis 14.00 Uhr.
(2) Feiertage sind
a) Ramadanfest (3 Tage)
b) Pilger-Opferfest (4 Tage)
c) Aschura (1 Tag).
(3) An den in Abs. 2 bezeichneten Tagen und während des Freitagsgebetes sind in der Nähe von Kultstätten und sonstigen Kultusgemeinden zu gottesdienstlichen Zwecken dienenden Räumen und Gebäuden alle vermeidbaren, Lärm erregenden Handlungen, die eine Beeinträchtigung der Feier zur Folge haben könnten, sowie öffentliche Versammlungen, Auf- und Umzüge, untersagt.

Die IGGiÖ stellt die Zertifikate aus, die Fleischhauer, die das Schächten betreiben, als Fachleute auf diesem Gebiet ausweisen. Es gibt einen eigenen Ansprechpartner, der für diesen Aufgabenbereich zuständig ist. Anträge können über das Büro der IGGiÖ gestellt werden.

Das Unglück ereignete sich in Mina, wo Gläubige symbolisch den Teufel steinigen
Mekka – Mehr als 700 Menschen sind bei einer Massenpanik während der muslimischen Pilgerfahrt Hadsch in Saudi-Arabien ums Leben gekommen. Bei der Panik während der symbolischen Teufelssteinigung in Mina seien zudem mehr als 800 Gläubige verletzt worden, teilte der Zivilschutz des Landes am Donnerstag mit. Es handelt sich um das schwerste Unglück während des Pilger-Großereignisses seit 25 Jahren.

Das ist mehr als nur ein organisatorisches Problem, mehr als Schlendrian
Dass viele der Flüchtlinge, die derzeit nach Europa drängen, auch vor dem Hunger in den Lagern rund um Syrien fliehen, weist auf ein tiefes Versagen der Weltgemeinschaft hin: Angesichts des weiter sich vertiefenden Syrien-Krieges kein Geld für Lebensmittelhilfe mehr lockerzumachen kommt unterlassener Hilfeleistung auf internationaler Ebene gleich.
Nun stellt sich heraus, dass auch Österreich zu den säumigen Zahlern unter den Staaten gehört – und zwar nicht etwa aus akutem Geldmangel oder politischer Uneinigkeit, sondern aus rechtlichen Gründen. Während das UN World Food Programme, um die hilfsbedürftigen Menschen in den Lagern bis Jahresende zu verköstigen, vor einem Fehlbetrag von 248 Millionen Euro steht, widmet man sich einem Vertragsunterzeichnungsmarathon.
Das ist mehr als nur ein organisatorisches Problem, mehr als Schlendrian: Angesichts der Dringlichkeit der Probleme äußert sich darin ein massiver Mangel an Solidarität. Dieser steht in Gegensatz zu den wortreichen Bekundungen der Regierungsspitze, wie wichtig die Erhöhung der EU-Lebensmittelhilfe in den vom Krieg betroffenen Staaten des Nahen Ostens denn sei.
Dass man sich beim World Food Programme gezwungen sieht, die Gelder aus Österreich vorzufinanzieren, setzt dem Skandal die Krone auf. Da bleibt nur zu hoffen, dass dazu zumindest kein Kredit aufgenommen werden muss. (Irene Brickner, 22.9.2015)

In Russia, the government continues to pursue its unprecedented crackdown on independent critics. For the fourth year in a row, parliament adopted laws and authorities engaged in repressive practices. The authorities used an infamous 2012 law that demonizes advocacy groups that accept foreign funding, to smear as “foreign agents” almost 90 nongovernmental organizations (NGOs), including the country’s leading human rights groups. At least 13 NGOs chose to close rather than bear the stigmatizing and untrue “foreign agent” label. In March 2015 parliament adopted a law on “undesirable foreign organizations” that authorizes the extrajudicial banning of foreign organizations that allegedly undermine Russia’s security, defense, or constitutional order. Russians who maintain ties with “undesirables” or share their materials with Russian audiences face penalties ranging from fines to a maximum six years in prison. In August, Russia banned as “undesirable” the National Endowment for Democracy, an American donor that had funded Russian rights groups. Various politicians urged the government to ban many other groups, deepening the climate of suspicion and fear.

Another trigger to the boatloads of Middle Eastern refugees crossing from Turkey to Greece this summer, taking advantage of the warm weather, has been the drastic drop in UN agencies’ provisions of food and medical aid because of cuts in UNHCR funding, the UN has been saying. As António Guterres, the UN high commissioner for refugees, bluntly warned in July, the agency was “financially broke.”
The UN has received just $1.67 billion of the $4.5 billion it needs this year to manage the Syrian refugee crisis. (Guterres recently announced that he was stepping down from his post by the end of the year. The UN has been silent about who is replacing him.)
The World Food Program had to cut rations for 1.6 million Syrians, with refugees in Lebanon allocated just $13.50 a month in July 2015. In Jordan, 229,000 refugees stopped receiving any food aid.

– Es gibt keine politische, wirtschaftliche, religiöse, mediale oder sonstige Organisation im Hintergrund.
– 100% des Erlöses werden gespendet.
Anfallende Kosten wie Pickerl, Drucksorten, Transporte, Website,… werden von Unterstützern seperat finanziert, schmälern also nicht den Spendenerlös. Der geht zu gleichen Teilen an Caritas Wir helfen. und den Verein Flüchtlingsprojekt Ute Bock.
– Es geht darum, zu zeigen, was Miteinander bedeutet und bewirken kann.
– Inspiration für die Aktion bekamen wir von Bob Geldof, Woodstock, Obi-Wan Kenobi, Train of Hope – Hauptbahnhof Wien #hbfvie und Group Hug United.
– Es gibt natürlich kein Copyright. Wenn wir andere Städte oder Branchen zu einer eigenen lokalen Hilfe inspirieren, dann freuen wir uns über eure Cover-Versionen!
– Lokale Hilfe steht für Offenheit, Gastfreundschaft, Mitmenschlichkeit, Xenophilie, Nächsten- und Übernächstenliebe.

فضائل يوم عرفة
صوم عرفة .. يكفر السنة الماضية و السنة القابلة

يوم إكمال الدين وإتمام النعمة
ففي الصحيحين عن عمر بن الخطاب رضي الله عنه أن رجلاً من اليهود قال له: يا أمير المؤمنين، آية في كتابكم تقرؤونها، لو علينا معشر اليهود نزلت لاتخذنا ذلك اليوم عيداً، قال أي آية؟ قال:
(اليوم أكملت لكم دينكم وأتممت عليكم نعمتي ورضيت لكم الإسلام دينا)
„المائدة: 3“
قال عمر: قد عرفنا ذلك اليوم والمكان الذي نزلت فيه على النبي صلى الله عليه وسلم، وهو قائم بعرفة يوم الجمعة.
عيد أهل الإسلام
قال صلى الله عليه وسلم: (يوم عرفة ويوم النحر وأيام التشريق عيدنا أهل الإسلام وهي أيام أكل وشرب) „رواه أهل السّنن“. وقد روي عن عمر بن الخطاب أنه قال: (نزلت –أي آية (اليوم أكملت)- في يوم الجمعة ويوم عرفة، وكلاهما بحمد الله لنا عيد).
يوم أقسم الله به
والعظيم لا يقسم إلا بعظيم، فهو اليوم المشهود في قوله تعالى
(وشاهد ومشهود)
„البروج: 3“
، فعن أبي هريرة رضي الله عنه أن النبي صلى الله عليه وسلم قال: (اليوم الموعود : يوم القيامة، واليوم المشهود : يوم عرفة، والشاهد: يوم الجمعة..) „رواه الترمذي وحسنه الألباني“.
وهو الوتر الذي أقسم الله به في قوله: (والشفع والوتر) „الفجر: 3“ قال ابن عباس: الشفع يوم الأضحى، والوتر يوم عرفة، وهو قول عكرمة والضحاك.
صيامه يكفر سنتين
فقد ورد عن أبي قتادة رضي الله عنه أن رسول الله صلى الله عليه وسلم سئل عن صوم يوم عرفة فقال: (يكفر السنة الماضية والسنة القابلة) „رواه مسلم“.
وهذا إنما يستحب لغير الحاج، أما الحاج فلا يسن له صيام يوم عرفة؛ لأن النبي صلى الله عليه وسلم ترك صومه، وروي عنه أنه نهى عن صوم يوم عرفة بعرفة.
اليوم الذي أخذ الله فيه الميثاق على ذرية آدم
فعن ابن عباس _رضي الله عنهما قال: قال رسول الله صلى الله عليه وسلم: (إن الله أخذ الميثاق من ظهر آدم بِنَعْمان- يعني عرفة- وأخرج من صلبه كل ذرية ذرأها، فنثرهم بين يديه كالذّر، ثم كلمهم قِبَلا، قال: (ألست بربكم قالوا بلى شهدنا أن تقولوا يوم القيامة إنا كنا عن هذا غافلين، أو تقولوا إنما أشرك آباؤنا من قبل وكنا ذرية من بعدهم أفتهلكنا بما فعل المبطلون) „الأعراف: 172، 173“ „رواه أحمد وصححه الألباني“
فما أعظمه من يوم! وما أعظمه من ميثاق !
يوم مغفرة الذنوب والعتق من النار و المباهاة بأهل الموقف
ففي صحيح مسلم عن عائشة _رضي الله عنها_ عن النبي صلى الله عليه وسلم قال: (ما من يوم أكثر من أن يعتق الله فيه عبدأ من النار من يوم عرفة، وإنه ليدنو ثم يباهي بهم الملائكة فيقول: ما أراد هؤلاء؟).
وعن ابن عمر أن النبي صلى الله عليه وسلم قال: (إن الله تعالى يباهي ملائكته عشية عرفة بأهل عرفة، فيقول: انظروا إلى عبادي، أتوني شعثا غبراً) رواه أحمد وصححه الألباني“.
